1. Introduction

These Terms & Conditions (“Terms”) govern the legal relationship between Adeptography (“Photographer,” “we,” or “us”) and any individual or entity (“Client,” “you,” or “your”) who engages our photography services. By booking a session or using our services, you agree to these Terms in full.

2. Booking & Payment

  1. Pricing & Quotes

    • All rates, packages, and quotes are based on the current Pricing structure at the time of booking.
    • Any additional fees (e.g., permit fees, travel expenses) will be communicated prior to confirmation.

  2. Deposit/Retainer

    • A non-refundable deposit/retainer may be required to secure your session date. This deposit is credited toward the total cost of your package.
    • Your date is not guaranteed until the deposit is received and a confirmation is issued.

  3. Balance Due

    • The remaining balance must be paid in full by or on the day of the session unless otherwise specified in writing.

3. Cancellation & Rescheduling

  1. Client-Initiated Cancellation

    • If you cancel, your deposit/retainer is non-refundable.
    • If you wish to cancel within [X days/weeks] of the session, additional fees may apply (e.g., the balance in full).

  2. Rescheduling

    • One reschedule is typically allowed without penalty if requested at least [X hours/days] in advance.
    • Rescheduling due to extreme weather or other uncontrollable circumstances will be handled on a case-by-case basis.

  3. Photographer-Initiated Cancellation

    • In the rare event the Photographer must cancel, all fees and deposits will be fully refunded, or an alternative date will be offered if acceptable to both parties.

4. Session Details & Creative Control

  1. Artistic Discretion

    • The Photographer retains full artistic judgment and control over all final images regarding composition, editing, and style.
    • While we consider client preferences, we reserve the right to refuse specific edits or setups that compromise our quality or safety standards.

  2. Coverage & Timing

    • For time-bound sessions (e.g., hourly booking), photography coverage will begin and end at the agreed-upon times.
    • Extensions may be possible subject to availability and additional fees.

5. Delivery of Images

  1. Turnaround Time

    • Standard delivery times vary by session type (headshots, portraits, weddings, etc.). Please refer to our FAQ or ask us for an estimated timeline.
    • Delays may occur during peak seasons or due to unforeseen circumstances; we will communicate any changes.

  2. Delivery Method

    • Images are typically delivered via an online gallery or secure file transfer.
    • Physical products (e.g., prints, albums) will be subject to separate production times and shipping costs.

6. Copyright & Usage Rights

  1. Photographer’s Copyright

    • All images created by the Photographer are copyright-protected. Ownership and full rights remain with the Photographer.
    • The Photographer may use the images for promotional or portfolio purposes as outlined in our Photo Release & Usage Policy, unless you opt out in writing.

  2. Client Usage

    • Clients receive a personal, non-commercial license to use images for personal, social media, or family sharing purposes.
    • Commercial or editorial use requires explicit written permission and may incur additional licensing fees.

7. Limitation of Liability

  1. Service Interruptions
    • We are not responsible for events outside our control (e.g., weather, venue restrictions) that may impact the session or resulting images.
  2. Technical Failures
    • In the unlikely event of equipment failure, data loss, or unforeseen accidents, liability is limited to the return of all payments received for the session or, if possible, a reshoot at no additional cost.
  3. Safe Environment
    • Both parties agree to maintain a safe and respectful environment during the session. We reserve the right to cancel or end a session early if safety or well-being is at risk.

8. Indemnification

Clients agree to indemnify and hold the Photographer harmless from any claims, damages, or liabilities arising from the Client’s actions, the location or venue, or any violation of these Terms.

9. Privacy & Data

We respect your privacy. Any personal data we collect is handled according to our Privacy Policy, which describes how we manage information, cookies, and email newsletters.

10. Force Majeure

Neither party shall be liable for any delay or failure to perform due to circumstances beyond reasonable control, including but not limited to acts of God, war, epidemics, lockouts, strikes, or natural disasters.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Location]. Any disputes shall be resolved through negotiation in good faith, and if not resolved, shall be settled in a court of competent jurisdiction in [Your Location].
